Patent practitioners have faced years of frustration in obtaining issued software patents, however, recent cases have demonstrated that the metes and bounds of patent-eligibility under 35 U.S.C. § 101 and have provided new surprising clarity.  This valuable hour will explore the Federal Circuit’s recent decisions in TLI Communications LLC v. AV Automotive LLC and Enfish, LLC v. Microsoft Corp.  The following topics will be discussed:  claim strategies for articulating a patent eligible invention; appropriately disclosing the algorithms; anticipating and overcoming inevitable rejections; claim techniques for software; pros and cons with non-publication requests.
