Presenter:  Benjamin Wilner, Ph.D., Alvarez & Marsal (Chicago office)

The presentation provides a brief overview of the lost profit damage calculation process in English rather than in the math language.  A general framework used by both plaintiffs and defendants to assess damages is detailed.  An emphasis is placed on describing the assumptions that underlie damages models.  Common critiques by opposing experts are analyzed through a case study format where two litigations are examined.  An analysis of how juries interpret damage testimony is also provided.

About the speaker:
Dr. Benjamin Wilner is a Ph.D. economist and statistician who regularly serves as a consultant and testifying expert witness on financial damages, economic & statistical issues.  Not only do he bring the modeling skills he honed working with three Nobel Laureate economists to his consulting work as well as his work on behalf of plaintiffs and defendants, but he also utilizes his experience teaching at three Big Ten universities to explain his models in English to clients, judges, juries and attorneys. 

Dr. Wilner’s disputes experience encompasses many industries and a broad range of single plaintiff, class action and criminal disputes including antitrust liability & damages, business interruption, business valuations, economic analyses, intellectual property, labor, lost income, product liability, statistical data analyses, and other corporate and litigation related matters.

In his consulting practice, Dr. Wilner advises corporations and governments on economic and statistical issues. For example, in addition to redesigning statistical aspects of an automobile manufacturer’s warranty process, Dr. Wilner received a special commendation from a senior official in the United States Department of Homeland Security for building an economic model to restructure a $2.5 billion tariff, which has won praise by a Cabinet member, Congressional officials, and the industry.

Dr. Wilner is a Managing Director with Alvarez & Marsal, and based in their Chicago office.
